Welcome to the ZiXXar Platform (“ZiXXar”, “we”, “us”, or “our”). These Terms of Use (“Terms”) govern your access to and use of our decentralized sales ecosystem, including our website, mobile applications, NFTs, blockchain services, and other related offerings (collectively, the “Platform”).

By accessing or using the Platform, you agree to comply with and be legally bound by these Terms. If you do not agree, you must not access or use the Platform.

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Platform. By using ZiXXar, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.

2. User Accounts

  • Maintain the confidentiality of your credentials
  • Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts for violations of these Terms or any unlawful activity.

You agree to use the ZiXXar Platform for lawful purposes only and in accordance with these Terms. You will not:

  • Use the Platform in violation of any applicable law or regulation
  • Infringe upon intellectual property rights
  • Engage in fraud, phishing, or manipulation of sales or incentives
  • Attempt to reverse engineer or disrupt the Platform’s infrastructure
  • Post or transmit any harmful, threatening, or abusive content

ZiXXar reserves the right to investigate and take legal action against violations.

4. NFTs, Blockchain, and Digital Assets

Some services on the Platform involve the use of NFTs and blockchain technology, including Xiden-based operationsand third-party integrations like OpenSea.

You acknowledge and agree that:

  • Transactions on blockchain networks are irreversible and immutable
  • ZiXXar does not guarantee the future value or performance of any NFTs or digital assets
  • You are solely responsible for securing your wallet and private keys
  • Gas fees and network charges are your responsibility

ZiXXar disclaims all liability related to NFT transactions and third-party marketplaces.

5. Intellectual Property

All content on the Platform—including logos, designs, text, software, graphics, and trademarks—is owned by or licensed to ZiXXar and is protected by copyright and other intellectual property laws.

You may not reproduce, distribute, or modify any part of the Platform without express written consent.

6. Payments and Rewards

All payments made through the Platform, including purchases of GEMS ($DGMX), NFTs, or other digital products, are final and non-refundable, except where required by law.

ZiXXar may offer rewards, discounts, or commissions through incentive programs. These may be subject to eligibility requirements, expiration dates, and may be modified or discontinued at our sole discretion.

7. Disclaimers

The Platform is provided on an “as-is” and “as-available” basis without warranties of any kind. We do not guarantee:

  • That the Platform will be uninterrupted or error-free
  • The accuracy or reliability of content or user data
  • That blockchain or third-party services will be available or functional

You use the Platform at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, ZiXXar and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from:

  • Your use or inability to use the Platform
  • Transactions involving NFTs, GEMS ($DGMX), or blockchain
  • Unauthorized access to your account or data
  • Third-party services or content

Our total liability shall not exceed the amount you paid to us, if any, in the last 12 months.

9. Indemnification

You agree to indemnify, defend, and hold harmless ZiXXar and its affiliates from and against any claims, damages, losses, or expenses arising from:

  • Your use of the Platform
  • Violation of these Terms
  • Any content you post or actions you take on the Platform

10. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, for violations of these Terms or other conduct we deem harmful to the community or Platform integrity.

You may terminate your account at any time by contacting us or using the account settings.

11. Changes to These Terms

ZiXXar may update these Terms from time to time. If we make significant changes, we will notify you via email or in-platform notice. Continued use after changes indicates acceptance.
